By downloading the Optical Disc Drive Compliance Test Software, you explicitly agree to the terms and conditions of this User and Redistribution Agreement

The Optical Disc Drive Compliance Test Software ("Software") is released by the National Institute of Standards and Technology (NIST), an agency of the U.S. Department of Commerce, Gaithersburg MD 20899, USA. The Software is intended to be utilized for research purposes only. The Software is PROVIDED "AS IS" and NIST makes NO WARRANTY, EXPRESS OR IMPLIED, OF ANY TYPE, INCLUDING NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE and NO WARRANTY OF MERCHANTABILITY, OF THE SOFTWARE OR ANY RESULTING PRODUCT. NIST disclaims and does not assume legal liability or responsibility for a USER's use of NIST-created or otherwise derived Software or the results of the use of such Software. NIST will not be liable for any damages of any type attributed to the use of the Software.

Pursuant to Title 17 United States Code Section 105 copyright protection within the United is not available for any work of the United States Government. USER acknowledges that this software contains work which was created by NIST employees and therefore such work is in the public domain and is not subject to copyright.

USER may not use, and agrees not to use, the name of NIST or the Department of Commerce on any advertisement, product or service which is directly or indirectly related to the Software or associated documentation. NIST does not directly or indirectly endorse any product or service provided, or to be provided, by USER, its successors, assignees, or licensees. USER shall not in any way imply that the results obtained from USER's utilization of the Software. Furthermore, while the Optical Disc Drive Compliance Test software supports the MultiRead specification developed by OSTA (as specified by the documentation provided on the OSTA website), the Optical Disc Drive Compliance Test software is no way endorsed by or an endorsement of OSTA or any of its products, and User Agrees not to imply such endorsement.

By executing this agreement or by downloading the Software, USER agrees to and accepts the terms and conditions of this Agreement.
